OK! AMERICA’S CUTEST BABY CONTEST
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
Eligibility: America’s Cutest Baby Photo Contest (“Contest”) is open to legal residents of the United States and the District of Columbia, residing in the United States, who are: (a) eighteen (18) years of age or older; and (b) the parent or legal guardian (or a grandparent with consent from the parent or legal guardian) (“Contestant”) of a child that is between 0-48 months of age at the time of entering the Contest (“Child”). Employees, officers and directors of Oddyssey Magazine Publishing Group Inc. (“Sponsor”), its parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to win prizes in the Contest. Void in Puerto Rico, Canada, and where prohibited by law.
Contestants will also be required to represent and warrant that they have sufficient rights to the Images, and all other materials submitted in connection with this Contest to grant the Sponsor the rights granted hereunder. If the Images are photographs taken by a professional photographer, or anything other than personal snapshots in which the Contestant holds or rights, or if they include any copyright notice, Contestants will be required to demonstrate that the copyright holder(s) has granted him the right to allow the Sponsor to reproduce and publish the photographs, by agreeing to and checking the box upon submission that such right has been granted. Contestant also agrees to have the signed Copyright Release readily available and provide it should Sponsor request it. Contestants are responsible for any financial reimbursement to the original copyright holder for the rights to publish the Images as provided herein; the Sponsor will not be responsible for any such payment, and will not be held under any obligation to publish a photo credit to the original copyright holder for the publication of an image. Contestants shall agree to hold the Sponsor harmless and to indemnify the Sponsor from any and all liabilities, loss, claims, or causes of actions, including reasonable attorneys’ fees and expenses that may be incurred by the Sponsor, arising out of or relating to my breach of any representation or warranty, or any other violation of these Official Rules. Failure to comply with these Official Rules will result in ineligibility of Contestant. All federal, state/provincial and local laws and regulations of the United States apply. How to Enter and Submit Photos: Beginning at 12:01 AM ET on April 23, 2014, log on to www.okmagazine.com/BabySweeps for the official online entry form. You must complete all information requested, the date of birth of the baby, name, city and state.
Submissions must be received by May 9, 2014 at 11:59 PM ET. Contestants will be able to e-mail one (1) photograph of the Child, (herein referred to as Image), in JPEG format using the instructions provided. Image must only include the Child. All images submitted must be sized at 7 width x 5 height and with a resolution of 300 dpi per square inch.
As set forth in greater detail herein, submission of Images and entry in the Contest constitutes consent to use the Images on said website, www.okmagazine.com and/or associated or otherwise affiliated websites. Except as otherwise permitted herein, only one entry per person will be accepted; all subsequent entries will be disregarded. No enhanced or altered photographs or photographs containing more than one person will be eligible. False, deceptive or incomplete entries or other information provided by Contestants throughout the Contest shall render the entry ineligible.

Notification / Terms: Winners will be notified by email or telephone on or about by May 16, 2014. Entry constitutes permission to use Contestant’s name on www.okmagazine.com, and its publications, or an affiliated or associated website, and their consent to use the name, photograph, comments and/or voice/video recordings and likenesses for advertising or publicity purposes, in any and all media – including but not limited to publications, online display, television, cable, video, DVD and/or film productions, wireless applications and other media channels and applications, and for advertising, promotions, other Contests sponsored by one or all of the Sponsor and other commercial purposes (whether by the Sponsor or any third party) – without additional compensation or permission, except where prohibited by law. This Contest shall be governed and construed by Florida law, and the exclusive venue for all controversies will be in state or federal court in Palm Beach County, Florida. The Sponsor reserves the right to crop or otherwise alter images. Contestant waives (or shall ensure that copyright holder waives if Contestant is not copyright holder) in favor of Sponsor and anyone authorized by them, any and all moral rights that Contestant (or copyright holder) may have in any image. If any Contestant does not return any document within the time frame indicated on the document, or cannot be contacted, Contestant will be disqualified.
Odds of Winning: Odds of winning depend on the nature, quality and number of eligible entries received. Decisions of judges are final and cannot be appealed.
Disclaimer and Release of Liability: The Sponsor and all its affiliates are not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to participants’ or any other person’, computer relating to or resulting from participation in this Contest; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. All decisions of the Sponsor shall be final and conclusive on all matters relating to the Contest.
General: The Contest is governed by the laws of the State of Florida.
