CHESTER Twp., Pa., (CBS) — The Delaware County District Attorney’s office has announced the arrest of the co-owners of a construction company located in Chester Township for stealing more than a quarter of a million dollars in payroll deductions intended to cover union workers’ healthcare and pension benefits.

69-year-old John Parks of Garnet Valley and 66-year-old Donald Kirk of Cape May, NJ now face multiple counts of theft and receiving stolen property for withholding and converting healthcare, pension, union, and apprentice deductions from union workers’ paychecks over a six-month period. Bank statements for the company they ran, Rite-Way Electric and Rite-Way Construction, showed that they coverted more than $274,900.12 for their own personal use between March and November of 2011.

That money was supposed to be sent by check to the union (IBEW Local 654) once per month, where it would be broken down and distributed to employees’ accounts.
