Prop. 215 turns 20 this year, and it is showing its age. Groundbreaking at the time, and still today, Prop. 215 is narrow in scope by design and necessity. It covered only two criminal statutes and never addressed the complex subjects we are facing today. If you recall Prop. 215 passing in 1996, as I do, you will remember it called on the Legislature to develop medical marijuana regulations. We can argue what legalization means all day long, but we cannot argue that state regulation is the antithesis of legalization because it’s not. The two concepts are married at the hip, or should be.
