On August 10, 2015 the Los Angeles labor law attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit against Seasons Hospice and Palliative Care of California, Inc. claiming the company failed to compensate their hourly employees the correct amount of overtime wages and allegedly failed to provide their California employees with meal and rest periods in accordance with the California Labor Code. The Seasons Hospice and Palliative Care of California, Inc. lawsuit, Case No. BC590870, is currently pending in the Los Angeles County Superior Court for the State of California. The class action complaint claims that the company allegedly paid their non-exempt employees non-discretionary bonus wages based on their performance for the company. The Complaint further alleges that as a matter of law the various bonus wages received by Seasons Hospice's employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by the company, the class action lawsuit claims other non-exempt employees working for Seasons Hospice were also not correctly paid all their overtime wages.
Additionally, the Complaint seeks penalties relating to alleged missed meal breaks because allegedly Seasons Hospice did not have a policy or practice which provided a full off-duty, thirty minute uninterrupted meal break to the Plaintiff and other California Class Members prior to their fifth (5th) hour of work.
