Question by SAChicky: Mtg. Servicer Asking for Financial Info?

The other day I received a call from the mtg. loan servicer on my mortgage account. This customer service rep. told me that they had not recieved my mtg payment for June. I proceeded to tell her that I did in fact pay the mtg payment and gave her the confirmation # (I paid by check by phone) I also told her that it had already cleared from my checking account. She then did a bit of research and confirmed that I had in fact paid June’s payment. Then she started to ask me for information that I was not comfortable with giving. She said she needed to”update their records” of my employment etc. I told her nothing from my employment household income etc. had changed at all. She then started to harass me telling me that I was 300.00 short of what I should be earning in order to make my monthly mtg payments. I have been making consistant payments since they have had my account. Then she said I should sell my home since I don’t make enough! Is this legal for them to do?

By the way, I can comfortably make my mtg payments. I have a 2nd job, and I don’t feel I need to inform them of this job. I am not looking to refinance this mortgage so why should I give them this info?

It is legal to ask but it is wrong. You have zero obligation to provide any information as long as you are making the payments.

I am having a hard time understanding why they would ask in the first place. My thinking is maybe they are having a lot of defaults so they may be trying to get rid of what they percieve is a risky loan.

Personally I would call the highest person you can find in their company and complain. They made a mistake in regard to your payment and then start giving you advice about selling the house?

They make money as long as you have a loan with them. If anybody gets pissy with you say “you know, because of this it got you to thinking…….. maybe I should consider shopping around for a refi with a different company”.

As long as you are paying you don’t have to tell them squat.
