KQRS’ “SHOW US YOUR RACK” Contest
Official Rules
A complete copy of these rules can be obtained at the offices of radio station KQRS-FM (“Station”), owned and operated by Cumulus Media Holdings Inc. or one of its subsidiary companies, 2000 SE Elm Street, Minneapolis, MN 55414, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct the KQRS “SHOW US YOUR RACK” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:
No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
This Contest is open only to legal U.S. residents age twenty-one (21) years or older at the time of entry with a valid Social Security number and who reside in the Station’s Designated Market Area (“DMA”), as defined by Nielsen. Void where prohibited by law. Employees of Cumulus Media Holdings Inc., its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the Station’s listening area, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren. The term “household members” refers to people who share the same residence at least three (3) months out of the year. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Contest Period. The Contest will begin at 12:01a.m., CST on November 14, 2016 and will run through 11:59 p.m., CST on December 1, 2016 (the “Contest Period”). The Station’s computer is the official time keeping device for this Contest.
How to Enter. You will automatically be entered into the Contest once you complete the following:
Online: Visit the station’s website at 92kqrs.com and upload one (1) picture of yourself with your prized deer and complete an entry form. One entry per person, per email address. All entries must be received by 11:59 p.m. CST on Sunday, November 27, 2016 to be eligible for the Daily and Grand Prizes. Late or incomplete entries will not be accepted.
Use of any automated system to participate is prohibited and will result in disqualification. Station is not responsible for lost, late, incomplete, invalid, unintelligible, inappropriate or misdirected registrations, all of which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The “authorized account holder” is the natural person assigned the telephone number by the wireless carrier or an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Station and will not be returned. Station reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.
Time Delay Between Over-the-Air Analog Signal and Internet Broadcast: Due to the time delay that exists between the Station’s analog over-the-air signal and the Station’s online webcast, listeners who listen to the Station online may hear the cue to call later than listeners listening to the Station’s analog over-the-air signal. As a result, the odds of an online listener entering this Contest on-air may be diminished.
Daily Prize Winner Selection. Starting on or about 9:00 a.m., CST on November 28, 2016, Station will select one (1) entry each weekday of that week for a total of five (5) entries to potentially receive a Daily Prize in a random drawing from among all valid entries received by Station during the Contest Period and entered to win the Grand Prize. The winning entrants will be announced on-air and contacted using the email address and/or telephone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winners are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.
Grand Prize Winner Selection. All Daily Prize Winners from the particular week of November 28, 2016, will also be entered into a random drawing to win one (1) Grand Prize, for a total of one (1) Grand Prize throughout the Contest Period. The Grand Prize drawing is conducted by the Station on Friday, December 2, 2016 on or about 9:00 am CST, with one (1) winner randomly selected from the pool of all qualified Daily Winners from that week. The Grand Prize winner will be contacted immediately following the Grand Prize drawing. The potential Grand Prize winner will be contacted using the email address and/or telephone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Station’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within three (3) days of notification will result in disqualification.
Verification of Potential Winner. POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY STATION WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by email and/or telephone call after the date of random drawing and/or winner determination. The potential winner will be required to sign and return to Station, within three (3) days of the date notice is sent, an affidavit of eligibility and a liability/publicity release (except where prohibited) in order to claim his/her prize, if applicable. A winner who returns the affidavit of eligibility and liability/publicity release will be deemed to have accepted the Contest Prize and thereafter will not be permitted to rescind their acceptance of the prize and/or return the prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and/or the liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that the potential winner of a prize is disqualified for any reason, Station may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
Daily Prize. Five (5) Daily Prizes will be awarded in this Contest. Each Daily Prize consists of $500 in Casino Bucks to be used for free slot play at St. Croix Casino-Turtle Lake (St. Croix Casino Turtle Bucks are only valid at St. Croix Casino located in Turtle Lake, Wisconsin, 777 Us Highway 8 63, Turtle Lake, WI 54889). ARV of each Daily Prize is $500. Winner is responsible for all taxes and expenses associated with prize receipt and/or use. Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received by Station during the Contest Period. Station reserves the right to substitute any listed prize for one of equal or greater value for any reason. Offer may be redeemed at the TLC Booth within St. Croix Casino – Turtle Lake. The TLC Players Club booth is open from 7 a.m. to 4 a.m. daily. Contact a shift manager for assistance during the hours the booth is closed. Valid photo ID required. Offer is non-transferable, non-negotiable. No copies or reproductions accepted. Free Casino Bucks cannot be redeemed for cash or used at another location; valid only at St. Croix Casino – Turtle Lake, located in Turtle Lake, Wisconsin, 777 Us Highway 8 63, Turtle Lake, WI 54889. Croix Casino is not responsible for lost or stolen coupons and reserves the right to amend or terminate this offer without notice.
Daily Prize Terms and Conditions: Offer valid for TLC Players Club Card members only during dates specified. Offer valid for slot machines located at St. Croix Casino-Turtle Lake during the valid dates. Once any part of this offer is downloaded it cannot be redeemed and must be played. Guests must have an active TLC Players Club Card to play slots. Offer is valid only to the TLC Players Club Card account number and name specified. Offer cannot be redeemed for cash. Offer is non-transferable, non-negotiable. St. Croix Casino reserves the right to amend or terminate this offer without notice.
Grand Prize. One (1) Grand Prize will be awarded in this Contest. The Grand Prize consists of one (1) trip for two (the winner and a guest) on a “Hunt the North” Minnesota guided whitetail deer hunt from the Watson Hunting Camp in Watson, Minnesota, which consists; four (4) days, three (3) nights single-room, double-occupancy accommodations at Watson Hunting Camp as selected by Station. GRAND PRIZE ARV $4,450. Winner is responsible for all taxes and expenses associated with prize receipt and/or use, including but not limited to costs of transportation to/from airport to resort and room taxes . Odds of winning the Grand Prize depend on a number of factors including the number of eligible entries received during the Contest Period. Station reserves the right to substitute any listed prize for one of equal or greater value for any reason.
Grand Prize Trip must be used during the 2017-2018 hunting season. Trip must be booked on or by August 1, 2017. Travel dates to be mutually agreed upon by winner and Station. Winner and guest must travel on the same itinerary. Winner’s guest must be twenty-one (21) years of age or older. Grand Prize Trip is non-transferable and no substitution will be made except as provided herein at the Station’s sole discretion.
Odds of winning the Daily Prizes and Grand Prize depend on the number of eligible entries received by Station during the Contest Period. Station reserves the right to substitute any listed prize for one of equal or greater value for any reason. Void where prohibited.
Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Station, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Station, Cumulus Media Inc., and its subsidiaries, related and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; (c) I am the true and rightful owner of the Photograph and I have the full right and authority to enter this Contest in favor of the Released Parties; (d) I, by signing this Release, agree to give to the Released Parties and its licensees, successors, and assigns a non-exclusive, worldwide and perpetual license to use, re-use, broadcast, and publish the Photograph, as well as my name, biographical and other information in whole or in part, as part of a composite, retouched or distorted in character or form, for any reason that the Released Parties deem necessary without compensation, including for advertising, promotional, and related purposes in connection with the activities or promotion of the Contest, unless prohibited by law. I agree to release, discharge, and hold the Released Parties harmless from any and all claims I may have against the Released Parties in connection with the use of the Photograph my name, and/or city of residence, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.
Except where prohibited, participation in the Contest constitutes winner’s consent to Station’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, unless otherwise prohibited by law.
All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
General Conditions. Station reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Station’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Station in its sole discretion. Station reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Station reserves the right to seek damages from any such person to the fullest extent permitted by law. Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance or completion of the Contest, or any part of it, for any reason, Station, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reason causes more than stated number of prizes as set forth in these Official Rules to be available or claimed, Station reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate state court located in the Station’s listening area; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state in which the Station is located, without giving effect to any choice of law or conflict of law rules (whether of the state in which the Station is located or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state in which the Station is located.
Entrant’s Personal Information. Information collected from entrants is subject to Station’s Privacy Policy, which is available on the Station’s website under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Station to be used, disposed of or destroyed in its sole discretion. Station is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to Station’s website.
Contest Results. A winners list may be obtained after December 5, 2016 by sending a self-addressed stamped envelope to the Contest Sponsor identified below.

GUEST TRAVEL RELEASE
This GUEST RELEASE is executed on the date set forth under the signature below by the undersigned guest (“Guest”), a guest invited to receive a ticket to attend the insert name of event and receive insert mode of transportation to and from insert locations and related accommodations (hereinafter collectively referred to as the “Trip”) by the winner of the insert name of contest (the “Contest”), in favor of radio station insert call letters, Cumulus Media Inc., its subsidiaries, affiliates, members, directors, officers, employees and agents (collectively, “Cumulus”), whose address is insert station address, sponsor of the Contest.
Guest hereby submits this Guest Release to Cumulus with the understanding that it will be relied upon to determine whether Guest is entitled to join the Contest winner on the Trip, and all activities in connection therewith (the “Trip”), for which Guest has been invited to participate.
Guest represents, warrants, covenants and agrees that Guest is undertaking the Trip entirely of Guest’s own choice and volition, and that it has not been requested, suggested or required in any way by Cumulus or the winner of the Contest that Guest undertake participation in the Trip. Guest acknowledges and recognizes that Guest’s activities in connection with the Trip may involve potential danger to Guest’s person and property and the property of others, including Cumulus, and knowingly and voluntarily intends to participate in the Trip. Guest represents that he/she is age 18 or older.
In consideration of being permitted to participate in the Trip, and with full knowledge, understanding and consideration of the inherent risks involved, Guest, by signing below, expressly assumes all risks of any nature whatsoever and does hereby release Cumulus of and from any and all claims, demands, damages, actions and causes of action, torts, obligations, costs, losses, claims, liability for bodily injury, death or other type of damage or injury of any nature whatsoever, including any damage or injury related to or arising out of Guest’s consumption of alcoholic beverages at any time during the trip, and any and all other liabilities of any kind or description whatsoever, whether in law or in equity, whether known or unknown, that Guest hereafter has or may have, arising from or by reason of or in any way connected with any transaction, event, or circumstance that occurs or exists by reason of Guest’s participation in the Trip, and any injury, damage or loss of any nature related to or arising out of or in connection therewith.
Guest, on Guest’s own behalf and on behalf of Guest’s heirs and assigns, does hereby now and forever fully and finally release, remise, acquit and discharge Cumulus of and from any and all rights, claims, debts, damages, demands, actions, liabilities, responsibilities, causes of action, covenants, suits and judgments, of any kind or nature whatsoever, including any damage or injury related to or arising out of Guest’s consumption of alcoholic beverages at any time during the trip, whether known or unknown, developed or undeveloped, anticipated or unanticipated, discoverable or undiscoverable, which Guest has or might have or might claim to have against Cumulus, arising out of or in any way related to or associated in any way with Guest’s participation in the Trip, and any injury, damage or loss of any nature related to or arising out of or in connection therewith. The release contained in this paragraph is intended to be broad and to release Cumulus from all liability for all claims arising out of any loss, damage or injury (including personal injury or death) to Guest’s person or property that results from any accident, transaction, event, circumstance, act or omission in connection with Guest’s participation in the Trip.
Guest covenants and agrees not to sue Cumulus upon any claim, demand, right of action, cause of action, lawsuit, damage, loss or expense of any nature whatsoever, in law or in equity, which Guest now has or has had or may hereafter claim to have or have had, against Cumulus arising from or by reason of any matters, conduct, transactions, liabilities or obligations, including Cumulus’s negligence, with respect to the participation in the Trip, as to which any Cumulus entity might have any resultant or consequent liability to Guest. Guest further covenants and agrees not to sue Cumulus upon any claim, demand, right of action, cause of action, lawsuit, damage, loss or expense of any nature whatsoever, in law or in equity, which Guest now has or has had or may hereafter claim to have or have had against Cumulus related in any way to Guest’s possession or consumption of any alcoholic beverages, including any and all alcoholic beverages that Guest possesses or consumes on the Trip.
Guest hereby gives Cumulus and its licensees, affiliates, and assigns the right to broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including Guest’s voice, recorded or live, for any reason that Cumulus deems necessary without compensation, unless prohibited by law, and Guest hereby releases any and all claims Guest may have against Cumulus for such use. Guest further acknowledges that Cumulus owns or will own exclusively any photographs of Guest used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and Guest hereby assigns all such ownership rights to Cumulus.
This Agreement shall be binding upon Guest’s heirs, successors, assigns and legal representatives. This Agreement shall be governed by and construed in accordance with the laws of the state in which the Station operates.
I HAVE READ THE ASSUMPTION OF RISK AND LIABILITY RELEASE PROVISIONS CONTAINED HEREIN AND I FULLY UNDERSTAND ALL OF THESE TERMS. I HAVE EXECUTED THIS GUEST RELEASE VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
